The Dusseldorf District Court has ruled out that it is illegal for a shopping site to use Facebook ‘Like’ button since the users aren’t warned properly about their personal data being shared over the social network.
The court stated that a fashion clothing website that is run by Peek & Cloppenburg didn’t get the right approval from users before it transferred their browsing data to the social networking site.
This case was brought to light by North Rhine Westphalia Consumer Association, who made claims that data was transferred by the site to Facebook through its ‘Like’ button, regardless of whether it was used or not.
With this practice, the tough data protection laws of Germany were violated and the retailer might have to pay a penalty of around £192,000.
Now P&C and other retailers would be warning the users before they like their Facebook pages. Warnings have been issued by the consumer group to 5 other websites as well.
P&C would be able to appeal this ruling, but sources say that the company would wait for the written judgment of the court before taking the decision.
A Facebook spokesman stated that the implications of this ruling were only specific to this case.
